By accessing or using Claivra (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time — continued use after changes constitutes acceptance.

Claivra is an AI-powered ad creative platform that generates ad concepts, images, headlines, and calls-to-action from website URLs. The Service uses artificial intelligence and third-party APIs to research brands and produce creative outputs.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and be at least 18 years old. We reserve the right to suspend or terminate accounts that violate these terms.

Paid plans are billed monthly or annually as selected at checkout. All fees are non-refundable except where required by law. You may cancel your subscription at any time — access continues until the end of the current billing period. We may change pricing with 30 days' notice. Free trial periods, if offered, convert to paid subscriptions unless cancelled before the trial ends.

You agree not to: (a) use the Service to generate illegal, defamatory, or harmful content; (b) attempt to reverse-engineer, decompile, or extract the underlying AI models; (c) use automated tools to scrape or overload the Service; (d) resell access to the Service without authorization; (e) upload malicious code or attempt to compromise system security; (f) impersonate another person or entity.

You retain full commercial rights to all ad creatives, images, and text you generate through the Service. Claivra does not claim ownership of your generated content. However, the Service itself — including its design, code, AI models, and branding — remains the exclusive property of Claivra. You may not copy, modify, or distribute the Service.

Content generated by the Service is produced by artificial intelligence and may not always be accurate, appropriate, or free from errors. You are solely responsible for reviewing and approving all generated content before use. Claivra does not guarantee that generated content will not infringe third-party rights. You agree to use generated content at your own risk.

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein. We may process URLs and website content you submit to generate ad creatives — we do not store or share the raw content of third-party websites beyond what is necessary to deliver the Service.

To the maximum extent permitted by law, Claivra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption. Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your specific requirements or expectations.

We may suspend or terminate your access at any time for violation of these terms or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and indemnification survive termination.

You agree to indemnify and hold harmless Claivra, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your generated content, or your violation of these terms.

These terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable rules, except where prohibited by law.
